Stilmoda situated in Via Udine, 4 in Lignano Sabbiadoro 33054 - Udine, manages through the use of a website www.stilmoda.it an on-line shop (http://shop.stilmoda.it). For all orders made through this website only the general terms and conditions indicated below will be exclusively applied.
The offers and sales of the products on the site SHOP.STILMODA.IT are regulated by these General Terms of Sale. The same terms may be periodically updated; those published on the site SHOP.STILMODA.IT and agreed on an at the moment of purchase are to be considered effective and binding. We therefore ask the purchaser to read through these terms and conditions carefully and to have them thoroughly understood before, prior to use of the services provided by the site on-line www.shop.stilmoda.it. Stilmoda points out that by using these services, the purchaser accepts to be binded to these Terms and Conditions.
The products purchased on SHOP.STILMODA.IT are directly sold by Stilmoda of Vidotto Maria Teresa, sole proprietorship abiding to the Italian law, with its head office in Lignano Sabbiadoro Via Udine, ?, registered to the CCIAA number REA UD-D257468, VAT registration number 02385310301. All the products sold on shop,stilmoda.it are original and Stilmoda strives to provide evidence on the originality of the clothes whenever asked to.
Availability of the product
The selection of clothes found on the Stilmoda site indicates the precise availability of each item, by size and colour, since the website is directly connected to the main warehouse where all the creations on display and their availability are updated in real time.The products on sale and their price are those indicated on SHOP.STILMODA.IT
Once Shop.stilmoda.it receives the order request, it reserves the right to verify the availabilty of the items purchased as well as check the validity of the transaction via credit card ,Paypal or bank transfer. In the event that the items ordered are not available or for some reason the order cannot be processed as requested by the Customer, Stilmoda will immediately send a notice to the Customer and the cancellation of the order from the e-mail address email@example.com since the product ordered is not available anymore. Stilmoda can replace whenever the products offered on sale on SHOP.STILMODA.it and their price.
Prices and currency
The price for each item is specified in Euro (€) and consists of
-Tax included (inclusive of 22% VAT), shipping costs excluded for all European Union countries;
-Tax except for 22% VAT), shipping costs excluded for all countries Extra European Union.
The shipping costs are indicated before payment and calculated according to where the goods will be sent to.
Any custom charges shall be borne by the customer in the case of shipping to Extra UE countries (DDU).
All orders are accompanied by an official invoice in Euro and contains the exact total amount of the purchase, as required by regulations on International commerce. The amount actually charged to the credit card account could be subject to changes ascribable to fluctuations in exchange rates or to banking fees: for more details, we suggest Customers contact their bank.
For each product chosen, a descriptive card is displayed, with an image and the essential characteristics, as an example (the colour, size, unit price).
The customer who buys products described and viewable on our site SHOP.STILMODA.IT accepts that the images of the products may differ in some way in colour or size on the photos or because of the browser and/or monitor used. Stilmoda is not responsible for any inaccuracies due to a particular configuration of the computer used by the Customer or a malfunctioning of it. To offer our customers a more convenient service, we have added the opportunity to place an order by phone contacting the marketing department at the number 0039 043171601. To purchase an item, the customer must register on line by filling in one’s credentials following the instructions provided on the registration page. The purchase order must be precisely filled out in all parts Only in this case will one be able to click on the icon ‘Confirm order’ of the ‘Basket’. After having added the desired item the four details clearly distinguished will appear, (basket, login, payment/shipping, order confirmation) which are the steps the customer must carry out to complete the order.
Should the customer need to modify the purchase order before finalizing the purchase, in other words the need to alter some of the data contained therein, he/she should follow the proper instructions for making a change indicated on the site; the customer therefore can modify the quantity required of the product he/she intends purchasing. By confirming the purchase, the customer fully accepts and acknowledges the general terms of purchase. Should Stilmoda find a mistake in the purchase order or should consider that the order can not be processed the Customer will be immediately notified. The purchase of products sold on SHOP.STILMODA.IT can only be completed by customers who have come of age and who act exclusively on their own behalf.
The customer will receive after having finalized his/her purchase a written confirmation of the ordered product, the sum to pay, with the details of the price of the product and the shipping expenses and any custom charges for extra UE countries.
It will not be possible to ask for any changes for orders which have already been processed. Any further added orders will be eventually shipped separately.
Orders are processed from Monday to Friday. Orders sent by 10.00 a.m. will be shipped on the following working day. Orders made after 10,.00 a.m. will be shipped within the next 2 working days. The ordered products will remain the property of Stilmoda up to the full payment of the realtive price.
The prices of the products are in Euros. Payments and returned goods shipped to Italy are billed in Euro.
The orders will be shipped and carefully wrapped in specific packaging that in turn will be placed inside heavy duty cardboard boxes. Shoes which are already provided with their own rigid box will be directly packaged inside them.
METHODS OF PAYMENT
Shop.stilmoda.it accepts the following methods of payment: credit card, bank transfer or Paypal.
Visa, Mastercard and American Express are accepted and all cards connected to them.
At the time of purchase, the Customer enters their credit card details in a protected electronic banking environment, provided by Banca Sella.
Maximum security of purchases is guaranteed since all transactions are managed by Bank Sella. Shop.stilmoda.it suggests, however, that you adhere to securecode by requesting a security code PIN services verified by Visa or Mastercard with which you can safely make your purchases.

If the funds on the card result being sufficient for the purchase and the bank data provided are valid then Bank Sella will immediately send a confirmation of the charge; the Customer receives an email with a transaction confirmation code.
In case of payment by bank transfer the Customer must send a copy of the payment via firstname.lastname@example.org within 2 hours from the confirmation e-mail. It is however possible to send an e-mail asking for a longer execution time to email@example.com. As soon as Shop.Stilmoda.it receives the sum due on its bank account, it will arrange for the shipping of the items. If Shop.Stilmoda.it does not receive confirmantion of the bank transfer then the order will be cancelled. Please note that any bank charges or bank transfer fees from abroad will be charged to the customer.
The Customer can pay via Paypal account, clicking on the icon Paypal and following the instructions on the site. After payment the customer will receive an e-mail which notifies the receipt of the payment and from that moment onwards the timeframe for the preparation of the item and shipping of the order will start.
SHIPPING AND DELIVERY METHODS
Delivery in Italy
All orders shipped in Italy will be delivered by DHL and need to a signature when consigned. Orders are consigned from Monday to Friday at the following hours: from 9.00 a.m. to 5.30 p.m..
Customers can send a request via e-mail to be contacted by the delivery company and agree on a specific delivery time.
Once the items have been shipped it will not be possible to change the shipping address.
Shipping to the rest of the world
Stilmoda ships all over the world. All orders are delivered by DHL from Monday to Friday.
All orders require a signature at the time of delivery. Once the items have been shipped it is no longer possible to change the destination address.
The shipment is made only with EXPRESS service and therefore forsees a single fare depending on the country of destination.
Requirements for import to the USA
American citizens and those who not but are residents in the USA and who import from abroad via purchases made on line are considered to be the final importer: they must therefore own and provide the courier or broker with a Social Security Number or, in the case of non-American citizens, a CBP - customs Border Protection Number. The procedure to obtain a CBP usually takes 10 working days.
In the event that the package cannot be delivered due to circumstances depending on the customer, (wrong address and telephone number, SSN number or CBP not provided) the parcel will be returned to Italy at the customer’s expense: these expenses include transport and customs duties charged returning to Italy which will be deducted from the final refund.

Delivery and shipment methods
For what concerns the shipment, the address provided on registration to the site will be used. It is necessary, therefore, to carefully and completely fill in the space “address”. We highly recommend the purchaser to directly get in touch with the delivery company if not at home in order to agree upon a delivery at a specific time slot so as to avoid further expenses.
The delivery expenses are displayed at the time of purchase confirmation and before payment.
The costs for a single shipment in Italy and worldwide are specified in the following table.

According to the destination selected, the price of the item is inclusive of VAT for all UE countries.
For all other countries VAT is not included in the price and the delivery will be DDU, that is, the price of the product does not include the taxes and the customs duties of the country of destination which will be charged to the Customer.

Delivery times and methods
The delivery times vary according to the destination. the time in which the order was placed and the availability of the product itself.
From the receipt of the order, the delivery time of the product will be as follows:
Italy 1 - 2 working days
Europe UE 2 - 3 working days
Europe Extra UE 3 - 5 working days
Russia 7 working days
Other destination 3 - 5 working days
The courier requires the signature “of receipt” from the recipient at the time of delivery and from that moment onwards the goods become property of the customer.
All products shipped are insured against theft/loss and damage from the moment they are entrusted to the Courier for shipment until delivery to the consignee.
If on delivery the package is damaged in any way the best course of action is to refuse the goods or to indicate on the delivery note that you accept with reserve a damaged parcel.
Once the goods are delivered to the address indicated and collected, the goods are no longer insured.
RETURNS AND EXCHANGES
Right of withdrawal
The Customer has the right to revoke the order for any reason according to the Law 206/2005 (Customer Code). This right can be exercised exclusively by customers ”consumers” (individuals who buy goods not for professional purposes connected to their commercial or entrepreneurial business).
Methods of withdrawal
The Customer should inform the withdrawal to STILMODA within 14 working days from the date of delivery via registered letter with acknowledgement of receipt. A letter communicating withdrawal may be sent via e-mail, but the registered letter must be however sent within the following 48 hours.
Any product to be returned must be sent in its original packaging and at the same conditions in which it was formely delivered. Returning the goods alone does not automatically give rise to an effective right of withdrawal from the contract.
The item must be returned intact (not worn, washed or altered), and packed away in its original packaging including all its accessory pieces: price tags, original accessory such as its authentic label and the security seal which must not prove to have been neither cut or damaged.
Shoes should be tried on a carpet and should be returned in their original packaging which is an integral part of the product. Shoes which are not returned inside their box or in a damaged shoe box may be rejected e returned back to the Customer. Items should be returned in a single package and using the same courier chosen for the original delivery. It is possible to return the garments only from the country in which the delivery was made. Return shipment is free of charge for Italy and countries in the European Union.
Return procedure for Italy
The cost of the returned goods is at the expense of Stilmoda for returns from Italy or from the UE.
The purchased goods may be returned within 14 days from the date of the delivery date. The acceptance of any returns beyond these terms will be at Stilmoda’s sole discretion.
To request a return it is necessary to send an e-mail to firstname.lastname@example.org, indicating in the e-mail the order number , the item codes, the reason for returning the goods and how one chooses to be refunded. The available options are: refund, change of size or a voucher. It is not possible to change piece.
The customer will receive an e-mail of confirmation from email@example.com with a summary of the request sent and the return authorization together with a pre-filled sheet with the address of destination to attach on the parcel and the information of which courier should be used for the delivery of the returned good.
We recommend the Customer to use only the courier indicated by Stilmoda and to keep a copy of the delivery document.
The cost of the return is at the expense of the Customer and under his/her full responsibility until confirmation of receipt from the Stilmoda warehouse if other couriers are used.
Stilmoda is not responsible for any damage ot theft/loss to returned goods with not insured deliveries.The returned good will be accepted only if the procedure indicated in the above paragraph is carefully followed. Unauthorized returns will not be accepted. Stilmoda will send an e-mail of confirmation of having received the returned goods and of activation of the refund process within three working days from the receipt itself. Stilmoda reserves the right to inspect the returned garments and if the returned goods do not satisfy the expected conditions, they will be sent back with costs and tax at the expense of the purchaser. In the e-mail of approval the option of how one chooses to be refunded will be indicated as specified below.
Reimbursement of the price of returned products takes place within 15 days from the date Stilmoda receives the returned goods.
Return procedure from abroad
For countries extra UE they are at the expense of the customer..
Stilmoda will handle the return. The Customer will receive within 3 working days a confirmation e-mail with an authorisation number and a label to be pasted on. At this point the parcel can be prepared pasting on it the label which has been sent by e-mail. The local courier will contact the Customer to agree upon a convenient date for collection within two working days..
The returned good must reach the warehouse within 14 working days from the authorisation date. Within 3 working days from the consignment of the returned goods, Stilmoda will send an acceptance confirmation e-mail
Stilmoda rewrves the right to inspect the returned goods and if the returned goods do not satisfy the expected conditions, they will be sent back with costs and tax at the expense of the purchaser. to send them back at the expenses of the purchaser. In the e-mail of approval the option of how one chooses to be refunded will be indicated as specified below.
In the case of a simple refund this will concern only the price of purchase of the good and not the delivery expenses or custom charges.
Stilmoda will endevour to execute the refund immediately, however within 14 working days from the date of acceptance of the returned good: the actual date of accreditation may be visible and may vary indipendently of Stilmoda’s responsibility.
The credit entry will be transfered on the same credit card or bank account used by the Customer for the payment.
The refunds are transfered in the same currency of when purchased. Any loss due to currency fluctuations will not be refunded.
Only changes in colour or sizes will be accepted for substitution provided they are available, not a change of piece. The delivery of the exchanged good is free of charge, the customs charges are at the expense of the Customer. The free of cost delivery is only granted for one sole free exchange for each authorized return.
The products received already damaged or manifesting defects of conformity are considered to be difective. Stilmoda reserves the right to refuse non-authorized difective goods. Stilmoda will arrange to substitute the difective good with an identical one, if available. The substituted product will be delivered via courier without any further charge. In the case of acceptance of an exchange of a difective good and the substitution is not possible, Stilmoda will provide a refund of the price of the good. In the event that the original delivery took place as a DDU with taxes and expenses paid out at destination, such amounts will be refunded if included in the return package the relevant documentation is sent to Stilmoda.
The returned shipment from Russia is at the expense of the customer who should however priorly send an e-mail of request for a refund authorization to Stilmoda. In the event of a request of an exchange in size or colour, the return shipment will be refunded via a voucher equal to the amount paid for the original shipment (€ 55,00).
In the event of a returned good with a request for a refund, the shipment costs will be at the expense of the customer.
When buying on the website shop.stilmoda.it , the customer must meet the following requirements:
Be at least 18 years old;
Meet the aforementioned requirements to access and stipulate binding contracts;
Have a valid e-mail address;
Own a valid credit card for the payment, (Visa, Mastercard, American Express), or a bank account for a bank transfer payment.
The site shop.stilmoda.it has been created and published with the aim of providing a service specifically for its Customers and the items displayed on the site are exclusively destined to the End User. We specify that an End User is a physical person acting for purposes other than their entrepreneurial or professional activity.
Conclusion of the contract
The present General Terms of Sale are pertinent to the relationship between shop.stilmoda.it and the Customer limited to purchases made on the site. With regards to anything not expressly regulated by these Terms and Conditions, please refer to the provisions of Legislative Decree 22 May 1999, no. 185 and to applicable Civil Code regulations.
By the Customer electronically sending the order confirmation, and it being received by, the contract is considered to be concluded. The transmission of the order implies as follows:
For the Customer: to unconditionally accept and agree to observe the conditions and terms provided in this section “General Terms of Sale”.
Stilmoda: the undertaking to provide products in the terms and conditions set out by this section, except for the cases in which Customers do not provide suitable solvency guarantees or do not fall within the category of End User.
Security and personal information
Stilmoda has adopted appropriate security measures to protect from any illicit access or use of personal data and information provided. The bank details are neither recorded or detained on the site shop.stilmoda.it, but are stored in a secured database of the bank used by Stilmoda and which appear on the transaction page solely for commercial transaction purposes.
All site cinteng of the website shop.stilmoda.it (drawings, illustrations, photos, texts, graphs, descriptions, brands, images and videos) is the exclusive property of Stilmoda or granted to it in use. It is prohibited to reproduce, represent, distribute or re-distribute the content of this website by any means whatsoever, whether in whole or in part, contained on the website shop.stilmoda.it.
All trademarks quoted on the site are the legal property of the companies who hold them. The content contained in the site is protected by copyright.

Stilmoda makes information available on its website in order to provide a service to its customers, but it declines any liability relative to any technical or de facto inaccuracies and/or typographical errors for which there are provisions, upon notification, for immediate correction. Stilmoda does not offer any guarantee that the information published on its own web site, is in conformity with the laws of the juridiction of the Customer’s country of residence.
Stilmoda declines all liabilities ascribable to any problems, damages or risks that users may encounter while using the site; the user shall bear all the risks connected to using it and accepts the responsinìbilty of a failure in use, loss of data and the costs due to assistance and repair to hardware and/or software used to surf on the site.
